[SMM Analysis] The US Imposes Anti-dumping Duties on Anode-grade Graphite from China, with the Combined Duty Rate Reaching 160%

[SMM Analysis] Recently, the US Department of Commerce issued the latest ruling again, announcing that it would impose an anti-dumping duty of 93.5% on anode-grade graphite imported from China,

In December 2024, the US Active Anode Materials Producers Association, jointly formed by multiple US-based graphite producers including Anovion Technologies, Syrah Technologies LLC, and Novonix Anode Materials, filed a complaint with federal agencies, alleging that Chinese graphite companies had violated anti-dumping laws.


On May 20, 2025, the US Department of Commerce initiated a parallel and independent countervailing duty investigation against anode-grade graphite from China. The preliminary decision of this investigation imposed a 6.55% countervailing duty on most Chinese producers, with Huzhou Kaijin New Energy Technology Co., Ltd. and Shanghai Shaosheng Knitted Undershirt Co., Ltd. being subject to countervailing duties of 712.03% and 721.03%, respectively.


Recently, the US Department of Commerce issued another latest ruling, announcing a 93.5% anti-dumping duty on anode-grade graphite imported from China, based on the determination that these products were sold in the US market at prices below fair market value. A fact sheet from the Department of Commerce obtained by Reuters indicated that the anti-dumping margin and cash deposit rate for all Chinese producers were set at 93.5%. This duty rate will be imposed in addition to the existing rates, resulting in an actual tariff rate of 160% for graphite products.


The anode graphite involved in this taxation specifically refers to materials with a carbon content of no less than 90% by weight, in forms including synthetic graphite, natural graphite, and mixtures of the two. As a key raw material for the anodes of lithium-ion batteries, this material finds wide application in numerous fields such as EVs, battery energy storage systems (BESS), consumer electronics, and medical devices.
